It was reported to us by ES, that the Gazelle validation was raising the issue when the text element is not provided, even when it was not specified in the template definition.
The reason for this is that the template definition is also compliant with the ruleset defined in the eHDSI Simple Observation template definition. And there the text element is mandatory.
